Terms of Service (Buyer)

Platform: Fashionkaam.in (the “Platform” or “Website”)
Owner/Operator: Vestiverse Private Limited ( “Vestiverse”, “we”, “us”, “our” )
Powered by: Shopify (hosting & commerce tooling only; see Section 9)
By visiting, interacting with, or using our Services (website, content, tools, features, products, and support), you agree to these Terms of Service (“Terms”) and our Privacy Policy [LINK], Shipping Policy [LINK], and Returns & Refunds Policy [LINK]. If you do not agree, do not use the Services.
1. Overview
1.1 We provide a curated shopping experience connecting buyers with independent designers, (“Sellers”). Unless expressly stated, Vestiverse is not the manufacturer/seller of record.
1.2 These Terms are an electronic record under the Information Technology Act, 2000 and the Intermediaries Rules, as amended.
1.3 We may update these Terms at any time. Your continued use after updates constitutes acceptance.
2. Access & Account
2.1 Eligibility: You represent that you are 18+ (age of majority) and, where applicable, you consent to supervised use by your minor dependents on devices you own/manage.
2.2 Registration: You may be asked for details (email, billing, payment, shipping). You warrant all information is true, current, and complete and that you have rights to provide it.
2.3 Security: You are responsible for safeguarding credentials and all activity under your account. Do not transfer/sell/assign your account.
2.4 Identifiers: Your verified mobile number and email are primary identifiers; we may use OTPs for verification. Keep them updated.
3. Products & Content Accuracy
3.1 Visuals may vary due to device/display settings; small variations are not defects.
3.2 We do not warrant that products/services will meet your expectations or exactly match renders/mockups.
3.3 Descriptions, pricing, availability, and features may change without notice; we may limit quantities or discontinue items.
4. Orders & Acceptance
4.1 Your order is an offer to purchase. Acceptance occurs only upon confirmation/dispatch by the Seller (or by us on the Seller’s behalf).
4.2 We may refuse, modify, or cancel any order (e.g., stock, pricing errors, risk flags). If changed or cancelled, we’ll attempt to notify you via your provided email/phone/billing address.
4.3 Your purchases are for personal/household use (no resale/export) unless expressly authorized in writing.
4.4 Returns/Exchanges are governed solely by our Returns & Refunds Policy .
5. Prices, Taxes, Billing & GST
5.1 Prices, discounts, promotions may change without notice. The price charged is the price at order time and appears in your confirmation. Posted prices exclude shipping/handling, duties/VAT for international orders, and other applicable taxes unless stated.
5.2 Business Purchases & GST: If eligible products are purchased with a valid GSTIN and matching entity details before checkout, the Seller may issue a GST tax invoice. Delivery/billing addresses should align with the registered place of business to help ITC.
5.3 You are solely responsible for accuracy of GSTIN/entity details and for any denial of ITC. PAN may be required for purchases ≥ ₹2,00,000 within stipulated timelines.
5.4 You agree to keep payment details accurate and authorize charges (price, shipping, taxes, duties).
6. Shipping & Delivery
6.1 Delivery timelines are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond control.
6.2 Risk & Title: Unless our Shipping Policy says otherwise, risk/title pass to you when the product is handed to the carrier.
6.3 Multi-Vendor Orders: Items may ship separately with separate tracking.

7. Marketplace Role & After-Sales
7.1 Commercial terms (price, shipping, delivery windows, warranties, after-sales) are offered by and agreed between Buyer and Seller.
7.2 We do not own/possess products, do not guarantee Seller performance, and are not obligated to mediate disputes (though we may assist per policy).
8. Payments, Refunds & Compliance
8.1 By initiating a transaction, you enter a binding contract with the Seller and agree to pay via supported methods/gateways.
8.2 Refunds (where applicable) are processed in INR to the source account, subject to our Returns & Refunds Policy [LINK], Seller confirmation, and gateway constraints.
8.3 We may set reasonable limits or delay confirmations for fraud checks and request KYC if required.
8.4 Gateway/banking failures are governed by your agreements with your issuer/gateway.
9. Relationship with Shopify
Fashionkaam.in is powered by Shopify (hosting & commerce tooling). Sales are directly between you and Vestiverse/Sellers. Shopify is not responsible for any sales, products, or losses related to your transactions with us. By using the Services, you release Shopify and its affiliates from claims/liabilities arising from such transactions.
10. Intellectual Property & Licensing
10.1 The Services (text, UI, graphics, logos, images, audio/video, arrangement) are owned by Vestiverse or its licensors/Sellers and protected by applicable IP laws.
10.2 Personal Use: You may use the Services for personal, non-commercial purposes. No reproduction, distribution, public display, scraping, or derivative works without written permission.
10.3 Design/IP Licensing: Some products include use licenses (e.g., single-use, limited reproduction, full IP acquisition) and/or digital/NFT certificates. Your rights are strictly limited to the license purchased; any unlicensed copying, manufacture, or commercial exploitation is prohibited.
10.4 Trademarks: Fashionkaam, Vestiverse, and their marks are proprietary. Shopify and other marks belong to their owners. Do not use without permission.
11. Optional Tools & Third-Party Links
11.1 You may access third-party tools/features “as is” and “as available” without warranties; use at your discretion and review third-party terms.
11.2 Third-party links/sites are not controlled by us. We are not responsible for their content, policies, products, or your dealings with them.
12. Feedback & Reviews
12.1 By submitting reviews, ideas, or feedback (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, and display such Feedback for any purpose.
12.2 You represent you own/have rights to the Feedback; it complies with law and these Terms; and you have disclosed any incentives. We may moderate/remove unlawful or objectionable Feedback.
13. Errors & Corrections
We may correct typographical errors, inaccuracies, or omissions (including pricing, availability, shipping charges, transit times) and update/cancel affected orders at any time without prior notice, including after submission.
14. Acceptable Use & Prohibited Conduct
You agree not to:
a) Violate laws, IP/privacy/publicity rights, or Platform policies;
b) Post unlawful, defamatory, obscene, hateful, harassing, or misleading content;
c) Upload malware or attempt unauthorized access;
d) Scrape, spider, crawl, or “deep-link” to circumvent structure;
e) Impersonate others, spam, run chain letters, or promote gambling;
f) Buy/sell prohibited/restricted items;
g) Create unreasonable load or interfere with Services’ security/features.
We may restrict/remove content or suspend/terminate access for violations.
15. Termination
We may suspend, limit, or terminate your access (and/or delete related materials) at our discretion, including for policy/legal violations or risk/fraud concerns. Your obligations accrued up to termination remain due. Sections intended to survive (e.g., IP, warranties, liability, indemnity, dispute resolution) will survive.
16. Disclaimer of Warranties
Except as expressly stated by us in writing, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness, non-infringement, or uninterrupted/secure operation). Information provided is for general purposes; reliance is at your own risk.
17. Limitation of Liability
To the maximum extent permitted by law, Vestiverse, our directors, officers, employees, affiliates, agents, contractors, service providers, licensors (and Shopify and its affiliates, to the extent applicable under Section 9) are not liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, savings, data, replacement costs), or for errors/omissions, malware attacks, payment gateway failures, or reliance on content. Our aggregate liability shall not exceed the amount you paid for the order giving rise to the claim.
18. Indemnification
You agree to indemnify, defend, and hold harmless Vestiverse (and Shopify per Section 9), and each of our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, penalties, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms/policies; (b) your violation of law or third-party rights; (c) misuse of GST details/invoices or licenses; (d) your use of the Services.
19. Privacy
Personal data is handled per our Privacy Policy and Shopify’s privacy practices applicable to hosted stores. Because Shopify hosts our Services, certain information about your access/use may be processed by Shopify and sub-processors in other countries. See our Privacy Policy for details.
20. Severability; Waiver; Entire Agreement; Assignment
20.1 If any provision is unlawful or unenforceable, the remainder remains in effect.
20.2 Our failure to enforce a provision is not a waiver.
20.3 These Terms plus referenced policies constitute the entire agreement, superseding prior understandings.
20.4 You may not assign/transfer your rights without our prior written consent. We may assign/transfer without notice.
21. Governing Law & Dispute Resolution (India)
21.1 These Terms are governed by the laws of India.
21.2 Any dispute shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996.
Seat/Venue: Mumbai, Maharashtra. Language: English.
21.3 Subject to arbitration, courts at Mumbai have exclusive jurisdiction.
22. Headings
Headings are for convenience only and do not affect interpretation.
23. Changes to These Terms
You can review the latest Terms at any time on this page. We may update or replace these Terms by posting changes. Where required by law, we will notify you and specify an effective date. Continued use after the effective date constitutes acceptance.
